Careers and Employment Privacy Notice

This notice describes the types of personal information that Brainyak, Inc. d/b/a GutCheck (“GutCheck”, “we” or “us”) may collect about employees, contractors and prospective employees or contractors and how that information may be used by GutCheck. If you provide GutCheck your personal information as an employee, contractor or prospective employee or contractor, you are agreeing to the use of that information as described herein.

Types of Personal Information That GutCheck May Collect

GutCheck may collect the following types of information regarding employees, contractors and prospective employees or contractors:

  • Names, email addresses, location and other contact information
  • Information on how an applicant found GutCheck
  • Educational, job history and other information establishing qualifications, including resumes and cover letters
  • GutCheck’s evaluation of qualifications, including responses to interview questions and GutCheck interviewer evaluations
  • Information regarding eligibility to provide services as a contractor or employee, including work authorization status
  • Any other information that is volunteered to GutCheck as part of an application process or attempt to become a GutCheck contractor

In addition, GutCheck may collect the following types of information regarding contractors:

  • Information required for GutCheck’s reporting obligations, which may include applicable tax IDs
  • Bank account and other payment information
  • Logs of activity on GutCheck devices, systems and networks

In addition, GutCheck may collect the following types of information regarding employees:

  • Information required for GutCheck’s reporting and tax withholding obligations, which may include applicable tax IDs
  • Bank account and other payment information
  • Periodic performance evaluations
  • Work-related communications
  • Information related to participation in company events such as dietary restrictions
  • Logs of activity on GutCheck devices, systems and networks

How GutCheck May Use Personal Information

GutCheck may use personal information of employees, contractors and prospective employees or contractors to:

  • Evaluate qualifications and process applications to become an employee or contractor
  • Communicate regarding employment or work opportunities
  • Comply with applicable laws and regulations
  • Perform background checks, provided that, such checks will only be performed in accordance with applicable laws and regulations

In addition, GutCheck may use personal information of contractors to:

  • Process payment
  • Communicate in connection with services being provided by a contractor
  • Provide access to GutCheck systems and networks
  • Monitor activities on GutCheck devices, systems and networks

In addition, GutCheck may use personal information of employees to:

  • Process payroll, including applicable withholdings
  • Provide employment benefits
  • Communicate in connection with work responsibilities
  • Provide access to GutCheck systems and networks
  • Monitor activities on GutCheck devices, systems and networks
  • To support GutCheck team building and activities

Your Responsibilities

If you intend to provide us with personal information of a reference or any other third party, it is your responsibility to obtain such third party’s consent prior to passing their personal information to us.

You are responsible for the content of the information you provide to us and you must ensure it is legal, honest, truthful, accurate and not misleading in any way.

Who Will Have Access to Personal Information

Access to personal information about you will be limited to those GutCheck employees, systems and/or contractors who have a business need to access such personal information and may include recruiters, human resources personnel, technical services personnel, managers and/or their respective designees.

In addition, GutCheck may also disclose personal information about you in order to:

  1. Protect the legal rights, privacy or safety of GutCheck or its employees, agents and contractors;
  2. Protect the safety and security of visitors to our web sites or other properties;
  3. Protect against fraud or other illegal activity or for risk management purposes;
  4. Respond to inquiries or requests from public authorities;
  5. Permit us to pursue available remedies or limit the damages that we may sustain; or
  6. Comply with other law or legal process.

Data Retention

If personal information is no longer needed for a relevant business purpose GutCheck may remove it from its systems, subject to GutCheck’s data retention obligations and policies and any applicable legal or regulatory obligations.

GutCheck may update this Notice from time to time to accurately reflect our information collection, use and disclosure practices, changes in industry practice or changes in law.
